Former Chairman of the U.S. Securities and Exchange Commission (SEC) Jay Clayton will have to wait a little longer before he officially becomes the U.S. Attorney for the Southern District of New York (SDNY), after New York Senator and Democratic minority leader Chuck Schumer blocked Clayton’s nomination, according to a Wednesday post on Truth Social by President Donald Trump.
The U.S. attorney position is a high-profile role because of the prominence of the SDNY, a federal trial court where major corporate criminal cases are often tried. Clayton, who has been lauded by some crypto pundits for being more open-minded than his successor, Gary Gensler, once said, “I am a huge believer in this technology,” during a 2021 interview on CNBC.
But Clayton lacks prosecutorial experience, and Schumer claims the only reason Trump nominated the former regulator for the prestigious position is to advance a nefarious plot by the president that seeks to eventually pursue and prosecute his political opponents.
“Donald Trump has made clear he has no fidelity to the law and intends to use the Justice Department, the U.S. attorney offices and law enforcement as weapons to go after his perceived enemies,” Schumer said, according to reporting by The New York Times. “Such blatant and depraved political motivations are deeply corrosive to the rule of law and leaves me deeply skeptical of Donald Trump’s intentions for these important positions.”
Trump fired back on Truth Social, praising Clayton’s credentials and experience and accusing Schumer of engaging in partisan politics.
“During my first term, Jay served with great distinction as the chair of the Securities and Exchange Commission, and earned the respect of everyone,” Trump wrote. “Chuck Schumer has announced that he is blocking all New York U.S. Attorney nominees.”
Indeed, Schumer has also blocked another high-profile Trump nominee, Joseph Nocella, who was nominated for the lead prosecutor role in New York’s Eastern District.
