The National Intelligence Council’s report from earlier this month determined and advised the executive branch that Venezuela is not direction an invasion of TdA into the US. That’s the grounds the Trump admin claims to use for the emergency powers under the Alien Invasion Act. The fact that it was already dicey, violated someone’s rights, and to be heard by the Supreme Court, this is likely the final nail in the coffin for Trump having *ANY* viable argument to this policy. We now know that his own intelligence council expressly told him that this was not an orchestrated “invasion” and he ignored that, made claims to the contrary AND had his team claim it in court (which is their third case of perjury in this matter) If the courts and Congress cannot come together over this and enforce the law, then America has failed as a democracy.
