Yeah especially because this is not a power of the executive branch at all.
Congress makes the laws.
Judicial determines their scope (“what the law is”)
The President’s job is the oversight and direction of the faithful execution of those laws.
That’s why an EO can’t make a new law, or overrule one, it can only implement a new guidance within the constitutional and legal frameworks.
Trump is trying to remove the authority of two co-equal branches of government, and in both cases at least half of each of those branches, are gleefully going along for the ride like willing idiots.
