The Montenegrin Constitutional Court unanimously dismissed jailed Terra Labs founder Do Kwon’s appeal against his extradition. This ruling paves the way for Justice Minister Bojan Božović to decide whether to extradite Kwon to the United States or South Korea, both of which have requested his extradition.
According to local reports, the Montenegrin government is leaning toward sending Kwon to the United States. In early August, Bitcoin.com News reported that a Montenegrin appeals court had upheld a lower court’s decision to extradite Kwon to South Korea.
Reacting to the Detention Panel of the Constitutional Court’s decision, Justice Minister Božović said:
“Due to the great interest of the public, I would like to point out that I will make a decision on the extradition of South Korean citizen Do Kwon after receiving the decision of the Constitutional Court.”
Explaining its verdict in an announcement shared via its website, the Montenegrin superior court said it found that the extradition process for the applicant was fair and did not violate Do Kwon’s right to family life. It also noted that Do Kwon had consented to extradition to both South Korea and the United States during the hearing.
Do Kwon was arrested in Montenegro in March 2023 for possessing and attempting to use forged travel documents. He was subsequently jailed for four months, a sentence his completed sometime in March this year. Since then, Do Kwon has been held at a reception center for foreigners while awaiting the extradition decision.
